Aweray Platform is the property of us. Please carefully read and fully understand the Terms of Use, especially the terms of the exemption or restriction of the responsibility of us, the terms of exclusion or restriction of user rights, and the terms of jurisdiction, etc. These terms are usually capitalized to remind you. BY USING AWERAY PLATFORM, YOU AGREE TO THIS TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE AWERAY PLATFORM.

1.Application and Acceptance of this Terms of Use

1.1 This Terms of Use is an agreement signed between users (or “you”) and us regarding the use of Aweray Platform related services and has contractual effect.
1.2 When you use a specific service of Aweray Platform, the service may have separate agreements and related business rules. The above contents will be published and demonstrated in various forms such as website announcements, notifications, messages, e-mails and help center documents. Once officially released, such separate agreements and related business rules shall be considered an integral part of this Terms of Use and you shall abide by it. Your acceptance of any of the aforementioned business rules and separate agreements is deemed to be your full acceptance of this Terms of Use. If all or part of the terms of the relevant separate agreements or related business rules are or is held invalid, the validity of separate agreements, related business rules or their terms shall not be affected thereby.
1.3 After you sign this Terms of Use, the content may be modified due to changes arising from your region or national policies, products and the environment in which this Terms of Use is implemented. The revised Terms of Use will be posted on Aweray Platform. If you disagree with the revised Terms of Use, please stop signing in or using Aweray Platform immediately. If you log in or continue to use Aweray Platform, you will be deemed to have approved the revised Terms of Use.
1.4 You may enter into orders with Aweray Platform, whether online or offline. If there is any conflict or inconsistency between this Terms of Use and the orders, the orders shall take precedence over this Terms of Use.
1.5 If we has posted or provided a translation of this Terms of Use, you agree that the translation is provided for convenience only and that this English version will govern your access to and use of Aweray Platform.

2.Service We Provide

2.1 We offer you a variety of products and services, including products such as AweSun, AweSeed, and AweShell. These products provide services to individual and corporate customers through forms such as PC terminals, App mobile applications, and clients, so as to achieve services such as remote computer control, network formation across different locations, and domain name resolution. The specific details are subject to the services provided by us by then. 2.2 AweSun: Including but not limited to services provided through AweSun Remote Control App, AweSun Host App and other channels. AweSun is a product that supports cross-system and cross-device remote control, supports a variety of system desktop devices and mobile devices, and can be used for remote management, remote assistance, remote device maintenance, remote training, remote office, mobile office and other scenarios. Service contents include: (1) Remote Desktop: Remotely control the computer via mobile phone to achieve remote desktop connection, supporting auditing functions such as screen recording. Provide remote assistance to customers, colleagues, friends and family from a different location. (2) Remote Assist: When the device malfunctions, you can share the complete status of your screen with technical support; technical support can perform a series of operations such as real-time chat, file transfer, viewing device information, and adjusting device settings through the software. (3) Screen Mirroring: Cast the mobile phone screen to the computer screen or TV screen. When gaming, cast to the computer desktop for game operation sharing. During meetings, use the screen mirroring function to remotely explain the content on mobile devices. (4) Remote Mobile Control: Control a mobile phone via another computer or mobile phone, helping others to remotely debug mobile phones, teaching parents how to use mobile phones, and operation demonstration. (Only supports some mobile phones) (5) Remote Gaming: Both mobile phones and computers can control remote computer games, enjoying remote games anytime, anywhere. (6) Remote Camera Monitoring: In addition to the camera on the PC, you can also use idle mobile phones to invoke the mobile phone camera, achieving remote monitoring and protection. (7) Remote File Management: Transfer files between mobile phones, computers and other multiple devices anytime, anywhere. (8) Remote Power On/Off: Paired with Sunlogin (or Aweray) remote power socket/power stick to achieve remote computer power on/off, helping you solve the trouble of "how to remotely control the switch when the computer is turned off". (9) CMD/SSH: Support remote command line, and complete operation and maintenance operations. (10) Remote Design: Supports digitizer tablet mapping and adopts YUV4:4:4 true color transmission to precisely reproduce the colors of the remote device.
2.3 AweSeed includes the Client and Game series.
2.3.1 Aweseed Client: Including but not limited to the services provided through the AweSeed Client App (PC version) and other channels. The AweSeed Client App is a smart networking software that can quickly build a virtual local area network (VLAN) across different locations. It adopts a new self-developed networking technology and a new VPC (Virtual Private Cloud) technology, supports network services such as http, ftp, and samba, and achieves intranet penetration without the need for a public IP, providing an easier-to-use, easier-to-implement, and more cost-effective networking solution.2.3.2 AweSeed Game: Including but not limited to services provided through AweSeed Game Edition App (PC and iOS), GameLink Global App (Android) and other channels. AweSeed Game mainly solves the problem that game users who are not in the same region or under the same network cannot perform LAN connection. It uses new technology to form a virtual LAN for users in the same game room to meet the needs of game users for remote connection in different places. Moreover, AweSeed uses asymmetric RSA/AES algorithm encryption to ensure data transmission security during the game. Main functions include: (1) Create Game Room: After selecting a connected game, you can create a game room under the game and invite friends to join the room for connected games. (2) Join Game Room: Choose any game room to join or join by searching for a room to quickly find game partners. (3) Online Gaming: Members in the same game room can automatically connect by clicking the connection button, which is simple to operate.
2.4 AweShell: Including but not limited to services provided through AweShell Client (PC) and other channels. AweShell is a domain name-based intranet penetration product. It mainly solves the problem that users cannot access internal LAN services from the extranet without a public IP or in complex network environments, meeting users' needs for cross-region remote access to Web services, databases, SSH, or remote desktops. The main functions include: (1) Create Mapping: Configure the IP and port of the intranet server, and select the extranet domain name for binding to create a mapping channel with one click. (2) Penetration Access: No matter where you are, without a public IP, you can directly access intranet services anytime and anywhere through the bound extranet domain name. (3) Remote Management: It supports remote management of domain name mapping through the cloud platform, adding or modifying mapping configurations, making operations and maintenance more efficient and convenient.

3.Who May Use the Services

3.1 You may use Aweray Platform only if you agree to form this Terms of Use with us and are not a person barred from receiving services under the laws of the applicable jurisdiction (e.g., regulations related to export control and economic sanctions).
3.2 If you are accepting this Terms of Use and using Aweray Platform on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so and have the authority to bind such entity to this Terms of Use, in which case the words “you” and “your” as used in this Terms of Use shall refer to such entity.
3.3 We do not allow the following individuals to access or use our services:
(1) If you have not reached the age of majority required by the applicable laws of your jurisdiction to access or use our services (refer to the Privacy Policy Appendix: Specific Provision for Different Jurisdictions);
(2) You have previously violated our terms and we have banned you from accessing or using our platform or services. In this case, you must obtain our consent to access or use our services, and you must understand that we can still refuse this right.
Please note that creating an account using false information violates our terms, including creating an account on behalf of a child or minor individual, or any individual who is not allowed to access or use our services.

4. Your Privacy

4.1 Your privacy is of great importance to us. Please read the Privacy Policy for the specific product as it describes the types of personal data we collect from you and your devices, how we use your personal data, and the legal basis we have to process your personal data. In some cases, we will provide separate notices and request your consent.

5. Your Account

5.1 You can sign in to Aweray Platform through Aweray user account and the third-party website account, including Facebook, Google, or you can enjoy limited services such as browsing and information review as an anonymous user.
5.2 You can create a Aweray user account by signing up online. You are responsible for all activities that occur under your Aweray user account. You warrant that we can contact you personally through relevant information. Aweray has the right to review whether the relevant information provided by your registration is true and valid. If the data information provided by you does not match the facts or the data information provided has changed but has not been updated in time or is suspected of being misleading, resulting in Aweray being unable to provide or further provide services to you, Aweray shall not bear any responsibility for this, and you shall bear the corresponding responsibilities and consequences that may be caused thereby. At the same time, please notice that registering a Aweray user account does not mean that you can use all the services provided by Aweray Platform.
5.3 You reserve the right to terminate your Aweray user account. When you decide not to use your Aweray user account, you shall first confirm that there are no situations that would cause the account to be unable to be cancelled under your Aweray user account. At the same time, you may withdraw all available funds (if any) from your Aweray user account or issue other legal payment orders, and apply to cancel your Aweray user account to us after paying off all the service fees. After the manual approval of us, your user account will be officially cancelled.
5.4 In the following circumstances, Aweray may unilaterally terminate the Terms of Use by cancelling the user account: (1) When you violate the relevant provisions of the Terms of Use or engage in any malicious behavior, Aweray has the right to suspend or terminate the provision of services to you; (2) When the Terms of Use are modified or updated, if you express your unwillingness to accept the new Terms of Use, Aweray has the right to terminate the provision of services to you; (3) Other circumstances in which Aweray believes it is necessary to terminate the provision of services.
5.5 If your Aweray user account is cancelled (whether by you or us), a few things happen. First, your right to use the Aweray user account to stop immediately. Second, we will delete all the data associated with your Aweray user account or will otherwise disassociate it from you and your Aweray user account, unless we are required by applicable laws to keep it, return it, or transfer it to you or a third party identified by you.

6. Account Security & Management

6.1 Please carefully keep your Aweray user account information, including the account number, password, verification code and other information. To protect your rights and interests, when setting your account password, please do not use simple passwords with repetitive or consecutive numbers. Please keep your password properly and do not reveal it to others. All losses caused by improper password storage shall be borne by you. Your Aweray user account can only be used by you and is prohibited from being transferred, traded, donated, rented or borrowed. If we find that your Aweray user account has been transferred, traded, donated, rented or borrowed, we reserve the right to ban your account without any notification and not to bear the legal responsibility to you. The resulting losses, including but not limited to service interruption and the clearance of user data and content are borne by the user. 6.2 In order to protect the transaction security, Aweray Platform may require you to complete the real-name authentication and provide more identity materials and information for further identity authentication or qualification verification when you need to activate some features and services of Aweray Platform. You must provide the true, latest, valid and complete information at the request of Aweray Platform, and update such information in a timely manner upon any changes to the relevant materials. You undertake to bear the corresponding legal liabilities for the information provided in accordance with the laws and regulations of your location and the provisions of this Terms of Use.
6.3 You agree to notify us immediately of any unauthorized use of your Aweray user account or any other breach of account security. We will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge.

7. Service Fee

7.1 Some services of Aweray Platform will charge certain service fees. For details, please refer to the business rules, notifications involved in the specific service. We may modify and change the charging standards and methods of the paid service according to actual needs, and may also charge for some free services. Before the above modification, alteration or start of charging, we will publish a notice or announcement on the corresponding service page.

8. Code of Conduct

8.1 You undertake not to use Aweray Platform for any illegal purpose or in any illegal way, undertake to comply with all applicable laws, and comply with all separate agreements, rules and guides related to Aweray Platform.
8.2 You agree and warrant that Aweray Platform may not be used to facilitate or assist the following acts, nor may it be produced, uploaded, stored, distributed or disseminated in connection with the following acts: (1)Spreading obscenity, pornography, gambling, violence, murder, terrorism, or abetting crimes; (2)Insulting, slandering others, or infringing on the lawful rights and interests of others.8.3 You agree and warrant that the use of Aweray Platform is subject to this Terms of Use and related business rules and controls, and may not be used to engage in, including but not limited to the following acts, or to facilitate the following acts: (1)Transferring, selling, renting, lending or sharing your Aweray user account with others; (2)Conducting any damage or attempt to damage the security of the network, including but not limited to viruses, trojans, malicious code, phishing, malicious scanning, illegal intrusion, unauthorized access, etc.; (3)Conducting any change or attempt to change the system configuration provided by Aweray Platform or to compromise the security of Aweray Platform; (4)Deleting all copyright information of Aweray Platform, conducting reverse engineering, reverse compiling, reverse compiling of Aweray Platform, or trying to find the software source code of Aweray Platform in other ways; (5)Copying, changing, modifying, linking to Aweray Platform commercially, or creating any derivative works or products, or using plug-ins, plug-ins or unauthorized tools to access, interfere with, or affect Aweray Platform; (6)Accessing or trying to access our Aweray Platform through web crawlers or other automatic methods, or violate robots.txt or similar files in Aweray Platform; (7)Using, leasing, lending, copying, modifying, linking, reprinting, compiling, publishing, or establishing mirror sites of data related to Aweray Platform commercially; (8)Conducting any operation done out of malice, or which may damage any rating or comment on Aweray Platform, and any act that may affect the integrity or accuracy of Aweray Platform; (9)Using technology or other methods to destroy and disrupt the operation of Aweray Platform and the use of Aweray Platform by other users; (10)Circumventing any restrictions on access to or availability of Aweray Platform; (11)Infringing upon the rights of others or engage in activities that violate the privacy or data protection rights of others; (12)Helping others break these rules.
8.4 If we find that your behavior violates applicable laws or this Terms of Use by its own or according to the information collected by other entities or individuals, we may take one or more of the following measures based on its independent judgment: (1)Requiring you to replacing and modifying the contents relating to Article 8.2 immediately; (2)Deleting and blocking related contents relating to Article 8.2 or disconnect links of these contents directly; (3)Restricting and suspending your use of our products, including but not limited to the direct downline of some of the services of Aweray Platform and restrictions on your operation of Aweray Platform, etc.; (4)Terminating of your use of Aweray Platform, including but not limited to the downline of all the services of Aweray Platform and the cancellation of your Aweray user accounts, etc.
8.5 When we take the measures under Article 8.4, we will provide you with a complaint channel, which will be notified by email, message, SMS or your phone.
8.6 If you violate applicable laws or terms of this Terms of Use in the process of using Aweray Platform, resulting in the loss of us, other users or any third party, you shall bear all the responsibilities, and we shall not bear any responsibility for this.

9. Service Suspension & Interruption

9.1 In view of the particularity of the network service, we may adjust or terminate some or all of the services of Aweray Platform at any time with justified reasons. However, we will inform you as soon as possible so that you can make backups of your data and business adjustments to protect your legal rights. If the changed, discontinued or terminated network service is our free product, we do not need to notify the user or assume any responsibility to any user or any third party. These justifications include the following: (1)Regular maintenance, such as examination, maintenance, and upgrade of Aweray Platform or related equipment on a regular or irregular basis for the provision of more complete services to users. (2)Force majeure, including but not limited to natural disasters, government actions, policy adjustments, laws and regulations’ adjustments, strikes and unrest or infectious diseases; (3)Basic operation fault, including but not limited to the technical adjustment of the telecommunications sector, the destruction of the telecommunications/power line by others, and the installation, modification and maintenance of telecommunications network/power resources by any third party; (4)Network security incidents, such as computer viruses, trojans or other malicious programs and hacking attacks; (5)The improper operations or the failures of your computer software, systems, hardware and communication lines; (6)The non-authorized use of Aweray Platform by users; (7)Other situations that are not caused by us, or cannot be controlled or reasonably foreseen by us.

10. Service Termination

10.1 If this Terms of Use or the services of Aweray Platform is terminated for any reason (including but not limited to force majeure, user arrears, user violations, etc.), for all data in your Aweray user account or any data stored in our servers due to the use of Aweray Platform will be kept for 1 month. You shall complete the migration and backup of all data in a timely manner. After the expiration of the retention period, we will automatically delete all your data.
10.2 You understand and agree that the suspension, interruption or termination of the services of Aweray Platform and/or Aweray user accounts does not represent a termination of your responsibility and you shall still be liable for possible breach of contract or damages during the use of Aweray Platform.

11. Limitation Liability

11.1 In any case, the responsibility for the use of the related services provided by the third party in the process of using Aweray Platform by the user shall be borne by the third party, and we shall not be responsible for such responsibility.
11.2 We do not provide any warranty or condition, express, implied or statutory, to any user and/or any transaction. Before making a trading decision, you shall fully understand the relevant transactions, make careful decisions based on their own trading objectives, risk tolerance and asset status, and bear all risks at their own risk. 11.3 Your access to and use of Aweray Platform are at your own risk. You understand and agree that the services of Aweray Platform are provided to you on an “AS IS” and “AS AVAILABLE” basis. Without limiting the foregoing, to the maximum extent permitted under applicable law, WE DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We make no warranty or representation and disclaim all responsibility and liability for: (1) the completeness, accuracy, availability, timeliness, security or reliability of Aweray Platform; (2) any harm to your computer system, loss of data, or other harm that results from your access to or use of Aweray Platform; (3) the deletion of, or the failure to store or to transmit, any content and other data maintained by Aweray Platform; and (4) whether Aweray Platform will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from Aweray Platform or through the services of Aweray Platform, will create any warranty or representation not expressly made herein.
11.4 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (1) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE AWERAY PLATFORM; (2) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON AWERAY PLATFORM, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (3) ANY CONTENT OBTAINED FROM AWERAY PLATFORM; OR (4) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF US EXCEED THE GREATER OF THE SERVICE FEES YOU HAVE PAID FOR THAT MONTH. THE LIMITATIONS OF THIS SUBSECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

12. Intellectual Property

12.1 We give you a personal, worldwide, non-assignable, non-exclusive license and term/usage limited (the term for free products is the same as the service provision term, and the term for paid products is the same as the subscription payment duration or usage amount) to use Aweray Platform. This license has the sole purpose of enabling you to use and enjoy the benefit of the services of Aweray Platform as provided by us, in the manner permitted by this Terms of Use. The granted right of use does not include any rights to the software source code.
12.2 The intellectual property rights, including but not limited to trademark rights, patents, copyrights and trade secrets of all contents on Aweray Platform, including but not limited to projects, images, files, information, documentations, platform architecture, platform screen arrangement and web design belong to us or other right holders. Without the specific written agreement of us or other right holders, no one shall use, modify, reproduce, publicly display, alter, distribute or publicly publish programs or contents of Aweray Platform. Without the specific written agreement of us, no one shall reproduce, copy, forge, sell, resell or access us or any part thereof for any commercial purposes.

13. Legal Application & Dispute Resolution

13.1 This Terms of Use shall be governed by and construed in accordance with the applicable laws and regulations in the People’s Republic of China. All disputes in connection with this Terms of Use or the execution thereof shall be settled through friendly negotiation. In case, no settlement can be reached through consultation, you agree to refer the dispute to the courts located in Yangpu District, Shanghai, China, and you consent to personal jurisdiction and waive any objection as to inconvenient forum.
